Understanding the K-1 Fiancé(e) Visa Process in Dallas
Procedure for filing a fiancé(e) visa:
- The U.S. citizen submits a visa petition, Form I-129F, and includes proof of citizenship status and that the couple met in person within the previous two years.
- When USCIS approves the application, the petition is sent to the National Visa Center who will forward the case to the U.S. Consulate where the foreign fiancé(e) lives. The foreign fiancé(e) will need to attend an interview and bring the required documentation. He or she must also complete a medical examination and receive vaccinations.
- Once a case has been processed and approved, the fiancé(e) in the foreign country will be given a passport with the K-1 visa.
At Akula & Associates P.C., our Dallas immigration lawyers can assist U.S. citizens who are seeking to bring fiancé(e)s into the United States. We provide smart and efficient guidance to facilitate the application process.
What Happens If My Fiancé(e) and I Do Not Marry Within 90 Days?
If you and your fiancé(e) on a K-1 visa don't marry within the 90-day period specified by the visa, it can lead to serious consequences. The primary purpose of the K-1 visa is to allow your fiancé(e) to enter the United States so that you can marry. If the marriage does not occur within this time frame, the visa status becomes invalid, and your fiancé(e) will be expected to leave the country promptly.
Failure to marry within the 90 days can result in overstaying your visa. You may be considered "out of status," making you ineligible for most immigration benefits and potentially subject to deportation.
It's crucial to communicate with your fiancé(e) and, if necessary, seek legal advice if unexpected circumstances arise that might prevent you from marrying within the allotted time. Extensions are rarely granted, so planning your wedding carefully and adhering to the visa requirements is essential to avoid complications.
