U.S. Citizens may file an I-130 petition for their spouses, children, parents, and siblings. Lawful permanent residents may file an I-130 petition for their spouses and unmarried children.
If the U.S. citizen or lawful permanent resident’s family member resides in the United States, in some instances, it may be possible for the family member to file an application to adjust status to permanent resident at the time of filing the I-130 petition. If the U.S. citizen or lawful permanent resident’s family member resides in a foreign country, they will need to wait until the I-130 is approved, and in some circumstances for visa availability, before applying for the immigrant visa at a U.S. consulate abroad.
