Who Qualifies for O-1 Visa?

|

O-1 visas are for creatives with extraordinary skills and experience. If you want to work in the United States as a creative, you need a set amount of skills, qualifications, and experience. Our Dallas immigration attorneys explain what qualifications are necessary to get an O-1 visa.

What Is an O-1 Visa?

The O-1 visa is for professionals with extraordinary abilities in the sciences, arts, education, business, or athletics. Professionals may also qualify if they have extraordinary achievements in the motion picture or television industry and have been recognized nationally or internationally for those achievements.

O-1 visas are only for internationally recognized individuals who have made significant contributions to their specialized field or industry and have a higher level of achievements. For example, individuals who have received a highly recognized award, such as a Nobel laureate, will have a higher chance of obtaining an O-1 visa.

Types of O-Visa Categories

There are different types of O-visa categories. According to the U.S. Citizenship and Immigration Services (USCIS), these are the different types of O-visa categories:

  • O-1A: This visa is for individuals with an extraordinary ability in the sciences, education, business, or athletics (not including individuals with an extraordinary ability in the arts)
  • O-1B: This visa is for individuals with an extraordinary ability in the arts or extraordinary achievement in the motion picture or television industry;
  • O-2: This visa is for individuals who will accompany an O-1 artist or athletes to assist in a specific event or performance; and,
  • O-3: This visa is for individuals who are the spouse or children of O-1 and O-2 visa holders.

How Can I Obtain an O-Visa?

You will need to submit a petition with the USCIS, plus your employer or agent must provide all required evidence and supporting documentation to prove that you are eligible for an O visa. Every visa application process can be complicated, and even one minor mistake can impact the outcome of your case.
