Removing Conditions on a Two-Year Green Card

July 18, 2026 · Akula & Associates, P.C.

Spouses who obtain a green card within two years of marriage receive conditional permanent residence, which requires filing an I-751 petition jointly with their spouse within the 90 days before the card expires.

The I-751 must include evidence that the marriage is genuine — joint finances, shared leases, photos, and affidavits from people who know the couple are all common forms of proof.

For couples who have divorced or separated, a waiver of the joint filing requirement may be available. We help clients prepare strong I-751 petitions and waiver requests when circumstances have changed.
