A legal permanent resident is a non-U.S. citizen who has the right to live and work in the United States permanently. Foreign nationals living abroad who want to relocate permanently to the United States can obtain permanent residency status through a variety of ways.
Foreign nationals can gain permanent residency status through:
- An immediate relative of the Petitioner who is a U.S. citizen
- A family member of the U.S. citizen Petitioner that fits into a preference category
- An employer who is filing on behalf of an individual as an employee
- Becoming an investor by investing at least $1,000,000 or $500,000 in an area of high unemployment or rural area.
For individuals already inside the United States, you can apply for an adjustment of status which will allow you to change your status without having to return to your home country. If you are outside of the United States, you will undergo consular processing.
Obtaining a Permanent Visa
- U.S. relatives must file Form I-130, Petition for Alien Relative. The application will require an original I-130, supporting documentation and USCIS filing fees. (Employers must file a labor certification and Form I-140).
- Upon the I-130 Petition approval a visa number for the Petition will be assigned. The Beneficiary can then apply for an Adjustment of Status through Form I-485 if he or she is legally in the U.S. or proceed with Consular Processing, if abroad.
