Eligibility and Approval Process for a K-3 Nonimmigrant Visa

In order to obtain a K-3 visa, a petition for alien relative (form I-130) must first be filed and submitted to a U.S Citizenship and Immigration Services (USCIS) “lockbox” on behalf of the foreign spouse. Once the document is received, the USCIS will send a form I-797, notice of action.

Eligible children of K-3 applicants may receive a K-4 visa when the child is

  1. Unmarried,
  2. Under the age of 21, and
  3. Listed on the parent K-3 Visa.

Applicants may then be given an interview with the U.S Embassy or consulate with further instructions on the completion of required processes such as medical reviews and administrative processing.
